1. These terms

1.1. What these terms cover. These terms and conditions govern your use of our services and content, whether you are a student, parent, or guardian, accessing the Springpod website and its services. 

1.2. Why you should read them. These terms provide important information about who we are, how we provide services,  how you and we may change or end the contract, what to do if there is a problem, and other significant details. By using our website, you agree to these terms, our Acceptable Use Policy, Privacy Policy, and Cookie Policy. If you have any concerns about these terms, please contact us. 

1.3. Children, students, and data protection. Springpod aims to facilitate student engagement with employers for career development. Users of this website must comply with all data protection laws, particularly regarding children.  Springpod acts as a facilitator and cannot be responsible for user interactions beyond our platform. By using our website, you agree to use the data only for career-related activities as intended by this website and not for personal relationships.


2. Information about us and how to contact us

2.1 Who we are. We are Springpod, which is the trading name for The Education Hub Group Limited a company registered in England and Wales. Our company registration number is 10150500 and our registered office is at The Education Hub Group Ltd (Springpod), Arch 6, 37 Tanner Street, London, SE1 3LF. Our registered VAT number is 287276850.

2.3 How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order or supplied through our site.

2.4 ”Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.


3. Our contract with you

3.1. Free and chargeable content. You can sign up for a free account on the Springpod website to access some content  without paying a fee. Other content and services are chargeable. 

3.2. How we will accept an order. For chargeable content and services, we will confirm acceptance of your order via  email or by providing the service online. This confirmation establishes a contract between you and us.

3.3. If we cannot accept your order. If we are unable to accept your order for chargeable services, we will inform you in  writing and will not charge you. Possible reasons include service discontinuation, resource limitations, or errors in  service description or pricing. 

3.4. Your order number. We will assign and inform you of an order number for reference in future communications.

3.5. International use. While our primary operations are in the UK, our services are accessible globally. Users outside the  UK should ensure compliance with local laws and regulations.


4. Our services

4.1. Service descriptions. Our services may vary slightly from descriptions on the website due to external factors or service updates.


5. Your rights to make changes

5.1. If you wish to change your service order, contact us. We will inform you if changes are possible and any effects on  pricing or delivery.


6. Our rights to make changes

6.1. Minor changes. We may make minor adjustments to reflect changes in laws or improve functionality without affecting your use of the service. 

6.2. Significant changes. For substantial changes, we will notify you, and you may end the contract before the changes take effect, receiving a refund for unused services. 

6.3. Digital content updates. We may update digital content to match the service description provided before purchase. 


7. Providing the services

7.1. Prices. The prices of subscription services will be communicated during the purchase process and may be subject to annual increases. 

7.2. Service provision. We will inform you of service start dates during the order process. Ongoing services or subscriptions will continue until completed, expired, or terminated per these terms. 

7.3. Delays outside our control. We are not liable for delays caused by external events but will communicate any expected delays and options for ending the contract.

7.4. Required information. If we need information from you to provide services and you fail to provide it, we may end the contract or charge additional fees. 

7.5. Service suspension. We may suspend services for technical reasons or policy violations, notifying you in advance unless urgent. Suspensions over 72 hours may result in price adjustments or contract termination with refunds for unused services. 

7.6. Non-payment. If you do not pay for services, we may suspend services until payment is made, with possible interest charges on overdue amounts. 

7.7. Account requirement. You must have an account on www.springpod.com to access services. We process your information as a Data Controller, even if received from another organisation. See our privacy notice at  www.springpod.com/privacy-policy.


8. Your rights to end the contract

8.1. Ending the contract. Your rights depend on what you bought, performance, and when you end the contract. See Clause 8.2 for specific reasons to end the contract. 

8.2. Reasons for ending the contract. Immediate termination and refunds apply if: 

8.2.1. We make significant changes to services or terms you disagree with. 

8.2.2. We notify you of pricing or service description errors. 

8.2.3. Supply delays are likely to be substantial. 

8.2.4. Technical reasons cause service suspension beyond three days.


9. How to end the contract with us

9.1. Inform us. Contact customer services at 02036378665 or email hello@springpod.com with your details and order information. 

9.2. Refunds. Refunds will be proportional to services supplied and paid within a reasonable time after the agreement. 


10. Our rights to end the contract

10.1. Breach of contract. We may terminate the contract if you breach terms, fail to pay, or provide the required information.

10.2. Compensation. If we end the contract due to your breach, we may deduct or charge reasonable compensation for incurred costs. 

10.3. Service withdrawal. We may stop providing services with seven days’ notice and refund any advance payments for unused services. 


11. Summary of your legal rights

11.2. Legal rights. You are entitled to services that conform to the contract, with repairs or replacements for faulty digital content. See Clause 8.2 for more details.


12. Price and payment

12.1. Service prices. Prices are shown during the order process, excluding VAT. 

12.2. VAT changes. We adjust VAT rates based on changes between the order and supply dates.

12.3. Pricing errors. We will inform you of and rectify any pricing errors, possibly ending the contract and refunding payments. 

12.4. Payment terms. Payment must be made before downloading digital content or as per invoicing arrangements.

12.5. Late payment interest. Overdue amounts may incur interest charges of 4% above the Bank of England’s base rate.

12.6. Disputed invoices. Contact us promptly if you believe an invoice is incorrect to resolve disputes without interest charges.


13. Our responsibility for loss or damage suffered to you

13.1. Foreseeable loss or damage. We are liable for foreseeable losses due to contract breaches or negligence but not for unforeseeable losses. 

13.2. Unlawful exclusions. We do not exclude liability for death, personal injury, fraud, or legal rights breaches.

13.3. Digital content damage. We will repair or compensate for device damage caused by our digital content, excluding avoidable or self-inflicted damage. 

13.4. Business losses. We are not liable for business losses, including profit loss, business interruption, or data loss.

13.5. Liability limitations. Neither party is liable for incidental, indirect, or consequential damages or data loss.

13.6. School or Employer clients. Liability is limited to the fees paid during the current contract period, with a cap on total liability.


14. How we may use your personal information

14.1. Privacy policy. Your personal information is used as outlined in our Privacy Policy.


15. Other important terms

15.1. Transfer of rights. We may transfer our rights and obligations to another organisation without affecting your rights.

15.2. Transfer restrictions. You may only transfer your rights with our written consent. 

15.3. Third-party rights. This contract is between you and us; no third party can enforce its terms.

15.4. Severability. If any term is deemed unlawful, the remaining terms will continue in effect.

15.5. Delayed enforcement. We can still enforce terms later if we delay enforcing them initially.

15.6. Governing law and jurisdiction. These terms are governed by English law, with legal proceedings in English courts. Scottish and Northern Irish users may choose their local courts. 

15.7. Alternative dispute resolution. You may use CEDR for unresolved complaints, with the option for online dispute resolution via the European Commission platform.


16. Competition

16.1. Share Your Success - Get Paid 

16.2. Eligibility. The competition is open to UK residents aged 13 and over. 

16.3. No entry fee. Participation is free, and no purchase is necessary. By entering, you agree to these terms and conditions. 

16.4. How to enter. If you receive and accept an apprenticeship offer advertised on Springpod from listed employer partners, you are eligible for a prize. Proof of the offer and acceptance within 28 days is required. You must have applied through Springpod or informed the employer that Springpod was the source.
